Activities
Main EU Legislative Proposals: Regulation (EU) 2019/880 of 17 April 2019 on the introduction and import of cultural goods
Commission Implementing Regulation (EU) 2019/1079 laying down detailed rules for implementing provisions of Regulation (EU) 2019/880
(Object of influencing activities for both regulations: to suggest amendments that would create a regulation better targeted on risk areas for cultural goods imported from countries outside the EU (such as from the UK) whilst recognising that antique items exported many years ago do not carry proof of export paperwork)
Proposal for a regulation on the prevention of the use of the financial system for the purposes of money laundering or terrorist financing
Proposal for a regulation establishing the Authority for Anti-Money Laundering and Countering the Financing of Terrorism and amending Regulations (EU) No 1093/2010, (EU) 1094/2010, (EU) 1095/2010
(Object of influencing activities for both regulations: to ensure that the anti-money laundering regulations are proportionate to the risk presented by works of art and to suggest a higher financial threshold for works of art to reflect this. Ensuring that smooth trade in works of art between the EU and third countries (such as the UK) is not hindered by un-necessarily bureaucratic measures that damage small businesses inside and outside the EU)
Participation in the Commission public consultation on an action plan against trafficking in cultural goods for 2022-25 (EU action plan launched 6 May 2022)
(Object of influencing activities: to ensure that the action plan allows for trade in cultural property between the EU and the UK striking a balance between preventing illicit trafficking and allowing small businesses to trade in licit cultural property.)
Regulation (EU) 2021/2280 of 16 December 2021 on the protection of species of wild fauna and flora
Commission Notice Revised Guidance Document EU regime governing trade in ivory 2021/C 528/03
(Object of influencing activities for both regulation and guidance document: to ensure that the measures recognise the cultural significance of antique objects that happen to be made from old materials such as ivory and in particular to recognise that the import and export of such items does not need to be banned, but should be controlled to ensure no modern ivory is traded)
Communication Activities: We have made either direct representations in written form or such representations have been made through the international confederation of art dealer associations (CINOA) on our and other members' behalf.
Representing the interests of both CINOA and our organisation an employee of our association has taken part in online meetings with Commission officials concerning the endangered species legislative proposals and the Import of Cultural Goods Regulations (EU) 2019/880 and (EU) 2021/1079, as well as prior to the finalisation of measures concerned with Regulation (EU) 2021/2280 concerning endangered species
