Mission & Interests
Goals: ECPY is the reference association for yachting professionals in France and Europe. Its role is to promote the interests of the profession to institutions.
ECPY focuses its actions on the economic development of the yachting industry and defends the interests and good practices of professionals, while cooperating with administrations, the government and the European Union to ensure a fair balance between the development of local, national and European regulations on the one hand, and the economic, environmental and social development of yachting on the other.
Thus, ECPY has been at the heart of negotiations, for more than 25 years, with tax, customs, social and environmental administrations, to ensure the pragmatic applicability of new measures, but also their consistency with neighboring countries: Italy, Spain, Malta, Croatia, Greece, Turkey… ECPY ensures in particular that no discrimination or distortion of competition can be established on a lasting basis.

Activities
Main EU Legislative Proposals: ECPY's fields of intervention
1°) Customs
- The Union customs code (Regulation 952/2013)
• Returned Goods relief: Willing to preserve the rights of UK flagged yachts after Brexit. The right to come back within 3 years shall, in our opinion, be preserved. The customs formality should not prevent UK flagged vessels that paid the VAT to enjoy free circulation in the European Union.
• Advocate for the definition of “outside the EU customs territory” to apply to a place located beyond the 12 nautical miles.
- The Delegated Act (2015/2446)
• The Temporary Admission: advocating for a clear definition of the yacht’s user within the framework of the temporary admission applicable to yachts.
• The Inward Processing Regime : advocating for being able to suspend the 18 month temporary admission time delay during the works without limit.
- Regulation 2018/886 : The tax on US built yachts: we have long advocated for its removal which has now been suspended.
- Regulation 2021/2083 :Suspension of tax on US built yachts: we aim for their full removal. This tax had a very negative impact on our activity. Our members suffered a huge loss of revenues due to the lack of American clients.
- Implementing regulation 2021/1832 : Aiming to keep the duty exemption on yachts above 12 meters and possibly extend the exemption to yachts under 12 meters.
- The exporters definition (2015/2446): We advocate also for the rights of non-EU established entities to act as exporters.
2°) VAT and Other taxes
- 2006/112/EC Directive : Article 148. The Case C-197/12 : our industry suffered from the consequences of this case on the tax regime applicable to High Seas Vessels. We aim to preserve the facilities granted to high seas vessels and consider the commercial yachts as proper commercial vessels.
- 2008/8/EC article 59 bis b) Use and enjoyment. We advocate for a lenient interpretation of this article to favor yachting activities in the European Union. Any commercial navigation carried out beyond the 12 nautical miles shall not be subject to VAT.
- Directive 2018/1910 (Quick Fixes): this directive had a negative influence on our activity as it forces yacht intracommunity sales to comply with very strict submission of proofs regarding the movement of the vessel.
- Tax on fuel article 14 Directive 2003/96/CE : We advocate for an harmonized tax on fuel applied on yachts throughout the European Union to avoid breaches of competition.
- One Stop Shop (Directive 2017/2455; Directive 2019/1995; Regulation 2019/2026). We advocate for fair rules within the European Union as many of our members are tax representatives. We do not want one country to attract all the non-EU companies for VAT registration purposes as it would create a breach of competition in the European Union in our opinion.
3°) Environment
- Directive 92/43/EEC : conservation of natural habitats and of wild fauna and flora. We advocate for the preservation of the environment without hindering the yachting activity beyond reasonable restrictions.
4°) Immigration
- Article 11 of the Regulation 2016/399 : the exit stamp on seafarers has great consequences on our activity. We advocate to loosen the position taken in the case C-341/18 by the European Court of Justice.
Communication Activities: ECPY organizes throughout the year "Open Days" allowing professionals to gather around the presentation of yachts for sale or charter, at the port of Nice. One of these events, on a larger scale, also allows for an annual review of the new provisions of the profession, the authorities and the various countries of the European Union in the field of yachting.
