Goals: L'Associazione Gruppo Apollo persegue la finalità di monitorare e sostenere la filiera dell’arte e dei beni di interesse culturale in Italia, con particolare riguardo alla loro circolazione in ambito nazionale ed internazionale, formulando proposte di riforma delle norme vigenti, al fine di migliorare e rendere più efficiente la funzione della tutela e della valorizzazione del patrimonio culturale italiano anche mediante azioni di incentivo e di sostegno del collezionismo e della fruizione dell’arte in Italia e dell’arte italiana all’estero. L'Avv. Activities
Main EU Legislative Proposals: Based on our vast experience in Italian and EU cultural heritage regulation, we plan to contribute to the EU’s role to assist and complement the actions of Member States in preserving and promoting Europe's cultural heritage.
Our Association has been pursuing a dialogue with the Italian institutions aimed at facilitating the circulation of art (and, consequently of knowledge and culture) within the European territory.
For example, we have been in constant dialogue with the Italian parliament members and policy makers to assess whether the cumbersome and bureaucratic control exercised by the Italian export offices on the international circulation of art (into and out of the Italian territory) is the most efficient way to protect the European cultural heritage.
We believe that an over-protective and over-controlling system has the deterrent effect of preventing foreign and Italian collectors from shipping their artworks to Italy or making them publicly available with loans to public museums. At the same time, also the fruition of Italian art by European citizens may be hindered due to a lengthy domestic export system guided by uncertain and overly discretional principles. We are planning to bring these issues to the attention of the European Institutions (EU Parliament and Commission) also in light of the Council Resolution on the Workplan for Culture 2023/2026 (2022/C 466/01).
In particular, we believe that a better circulation of art within Europe is consistent with the following Guiding Principles (Annex I) of the above-mentioned Resolution:
- Culture, including cultural heritage, has an intrinsic value and contributes to strengthening European identity.
- Cultural and linguistic diversity are fundamental assets of the EU and are to be respected, promoted and enhanced, including through mobility and the circulation of works. (emphasys added).
- Freedom of artistic expression and creativity are fundamental to the human ability to address challenges, to think critically, to innovate and to invent, and they must be encouraged and supported in all relevant ways.
- Cultural diversity and intercultural dialogue are essential for the promotion and protection of human rights; they foster mutual understanding, help prevent and resolve conflicts and promote reconciliation, peace and international stability, and any misuse of culture with the aim of spreading war propaganda and disinformation and of instigating hatred is incompatible with the fundamental values and principles of the EU.
- Culture makes a significant contribution to sustainable development, the economy and social inclusion, enhancing territorial cohesion.
- Culture has the potential to promote equality and mutual respect, and to fight against all forms of violence, discrimination, intolerance and prejudice.
